Rep. Eric Swalwell said that he’s bracing for the likelihood that the Trump administration will pursue charges against him.
“I’m ready for it. I fully expect it,” Swalwell told “CNN News Central” after being asked whether he feared that his vocal criticism of the White House could result in prosecution.
The California Democrat said he views such a scenario as inevitable, pointing to past writings by FBI Director Kash Patel.
Patel previously published a book identifying 60 figures he branded “government gangsters” who he argued should be investigated.

According to Swalwell, both he and fellow Californian Adam Schiff, who are both prominent Trump critics, topped that list.
Schiff, who once served with Swalwell in the House, is now being investigated, a fact that Swalwell said signals what is coming next and isn’t afraid of it.
“Adam Schiff is under investigation now, so, I’m ready for it. I expect it, but I’m not going to flinch,” he stated.
“I’m not hiding under the bed. I’m not going to shrink because that’s the aim. That’s why they do this, is they hope that dissent and oversight goes away,” Swalwell said.

He insisted he will not be silenced or deterred. “And if I shrink and if Adam Schiff shrinks, then why wouldn’t everyday Americans shrink?” he continued.
“And so, I’m not going away. And they can come at me, but it’s not going to silence me, and it’s not going to stop me from working every day to put Democrats in the majority so we can finally pump the brakes on the corruption we’re seeing in this administration.”
The congressman’s warning landed on the same day that former FBI Director James Comey was indicted by the Justice Department.
The charges include making a false statement and obstruction of a congressional proceeding, stemming from his 2020 testimony before the Senate.

The indictment marks the first time one of Trump’s long-time critics has been formally charged.
Attorney General Pam Bondi issued a post on X that seemed to reference the case without naming Comey directly.
“No one is above the law. Today’s indictment reflects this Department of Justice’s commitment to holding those who abuse positions of power accountable for misleading the American people. We will follow the facts in this case,” Bondi wrote.
According to the U.S. Attorney’s Office for the Eastern District of Virginia, which is handling the case, Comey could face up to five years in prison if convicted. His arraignment is scheduled for October 9.
Comey addressed the indictment in a video posted to Instagram. He said his family has long understood what opposing Trump could mean for them.
“My family and I have known for years there are costs to standing up to Donald Trump. But we couldn’t imagine ourselves living any other way. We will not live on our knees, and you shouldn’t either,” Comey said.

He went on to share advice that he attributed to his daughter, who was fired as a federal prosecutor earlier this year.
“Somebody that I love dearly recently said that fear is the tool of a tyrant. And she’s right,” Comey said.
He added that he refuses to live in fear and urged Americans to stay tuned in.
“I hope instead you are engaged. You are paying attention, and you will vote like your beloved country depends upon it, which it does.”
“My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system,” he said. “And I’m innocent. So, let’s have a trial. And keep the faith.”
Rep. Jamie Raskin, the top Democrat on the House Judiciary Committee, cast doubt on the likelihood of a conviction.
Appearing on MSNBC’s “The Briefing,” Raskin argued the charges were politically motivated.
“So the good news is, I think there’s very little chance he could ever be convicted, because it’s so clearly a case of vindictive and selective prosecution, where all of the norms of the rule of law have been suspended,” he commented.
“The president didn’t care about the facts, and the president didn’t care about the law, he just cared about his emotions, and it was a vengeance campaign,” Raskin said.
He added that a judge or jury is unlikely to see enough evidence to convict the former lawman.
“So I think either the judge will have to throw it out, or a jury hearing it will see it and simply…it cannot find that there is remotely enough evidence to convict,” Raskin told host Jen Psaki.
Meanwhile, Trump celebrated the indictment online. In a triumphant Truth Social post, he wrote, “JUSTICE IN AMERICA! One of the worst human beings this Country has ever been exposed to is James Comey, the former Corrupt Head of the FBI.”
“Today he was indicted by a Grand Jury on two felony counts for various illegal and unlawful acts,” he added.

“He has been so bad for our Country, for so long, and is now at the beginning of being held responsible for his crimes against our Nation.”
The president has long accused Comey of fueling what he called a “witch hunt” over his campaign’s ties to Russia during the 2016 election.
Trump dismissed Comey in 2017 while the investigation was still underway, a move that led to the appointment of special counsel Robert Mueller.
